These Terms and Conditions ("Terms") govern your engagement with INFOMetric Pty Ltd (ABN: 34 674 004 169) and your use of our website infometric.com.au. By engaging our services or using our website, you agree to be bound by these Terms.
INFOMetric Pty Ltd is an information technology services company registered across Australia, Australia (ABN: 34 674 004 169). We provide managed IT services, cyber security, cloud solutions, web management, hardware and software supply, internet and telephony, business automation, and Power BI reporting services to small and medium businesses.
All services are provided subject to a separate Service Agreement or Statement of Work agreed between INFOMetric and the client. These Terms apply in addition to any Service Agreement. In the event of conflict, the Service Agreement prevails.
Standard support is provided during business hours: Monday to Friday, 8:00 AM to 6:00 PM AEST, excluding Queensland public holidays. INFOMetric does not offer 24/7 support unless specifically agreed in writing within a Service Agreement.
You agree not to use INFOMetric's services or infrastructure for any unlawful purpose, to transmit harmful, offensive, or infringing content, to attempt unauthorised access to any system, or to engage in any activity that disrupts or damages INFOMetric's systems or those of other clients.
All intellectual property rights in materials, software, scripts, and documentation created by INFOMetric remain the property of INFOMetric Pty Ltd unless explicitly transferred in writing via a signed IP Assignment Agreement.
Both parties agree to keep confidential all proprietary, technical, commercial, and client information disclosed during the engagement. This obligation survives termination of the Service Agreement for a period of 3 years.
To the maximum extent permitted by Australian Consumer Law:
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
The parties agree to attempt resolution through good-faith negotiation before commencing formal proceedings. If unresolved after 30 days, disputes shall be referred to mediation in Brisbane, Queensland before litigation.
These Terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland.
INFOMetric reserves the right to update these Terms. Continued use of our services following notice of changes constitutes acceptance of the updated Terms.
